Running Fox Tour Co. Activity Waiver & Release of Liability

1. Acknowledgement of Risks

I UNDERSTAND THAT GUIDED TOURS, HIKING, WALKING, AND RELATED ACTIVITIES INVOLVE INHERENT RISKS THAT CANNOT BE ELIMINATED, EVEN WITH THE GREATEST CARE, INCLUDING BUT NOT LIMITED TO:

• Slips, trips, falls, uneven/rough terrain, rock/ice hazards

• Injury, illness, death, frostbite, hypothermia, or heat-related issues from weather/exposure

• Wildlife encounters, remoteness from immediate medical care

• Equipment failure, transportation delays/issues

• Other risks inherent to outdoor Alaska activities

I voluntarily choose to participate and accept full responsibility for these risks.

2. Health and Ability

I confirm I am physically able to participate in this activity and have no medical conditions that would increase my risk of injury. I agree to follow all safety instructions from Running Fox Tour Co. guides and inform the guide if I feel unsafe or unwell.

Running Fox Tour Co. may remove me from the tour without a refund if my behavior is unsafe or disruptive.

3. Release of Liability

IN CONSIDERATION OF BEING PERMITTED TO PARTICIPATE, I HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE

Running Fox Tour Co., its owners, guides, employees, volunteers, and affiliates

FROM ANY AND ALL CLAIMS, DEMANDS, ACTIONS, OR CAUSES OF ACTION FOR INJURY, DEATH, PROPERTY DAMAGE, OR LOSS ARISING FROM MY PARTICIPATION, INCLUDING THOSE CAUSED BY THE ORDINARY NEGLIGENCE OF THE RELEASED PARTIES, TO THE FULLEST EXTENT PERMITTED BY LAW.

THIS RELEASE DOES NOT APPLY TO CLAIMS ARISING FROM GROSS NEGLIGENCE, RECKLESS CONDUCT, OR INTENTIONAL ACTS.

4. Indemnification

I agree to indemnify and hold harmless Running Fox Tour Co. from any claims brought by or on behalf of me, my family, my estate, or any third party relating to my participation.

Media Release

I allow Running Fox Tour Co. to use photos or videos of me from the tour for promotion without payment.

I HAVE CAREFULLY READ THIS ENTIRE AGREEMENT, FULLY UNDERSTAND ITS TERMS, INCLUDING THE RELEASE OF LIABILITY FOR NEGLIGENCE, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT DURESS.

By signing electronically, I acknowledge that I have read and understood this Waiver and Release of Liability, and agree to be legally bound by its terms. I understand that this electronic acceptance is the legal equivalent of my handwritten signature.

A parent or legal guardian must sign this waiver for participants under 18.
